Planners and council to hear request to rezone 27.5 acres on FM 902 for a wastewater resource recovery facility

A public notice sets back-to-back hearings at 6 p.m. Oct. 20 on moving a FM 902 tract from single-family to heavy manufacturing zoning. Written comments are due by 5 p.m. Oct. 16.

A 27.5-acre tract on FM 902 would move from single-family zoning to the city's Manufacturing 2 district, with a wastewater resource recovery facility listed as the intended use, under a request headed for two public hearings later this month.

The City of Howe posted a notice of the hearings on its website. Both are scheduled for Tuesday, Oct. 20, at 6 p.m. at 100 E. O'Connell St.: first before the Planning and Zoning Commission, which is to issue a final report and recommendation, and then before the City Council, which takes up the ordinance after receiving that report.

The property

The notice describes the land as 27.532 acres in the Mary A. Miller Survey, Abstract G-0776, and identifies it as Grayson Central Appraisal District property 130789, listed under Silver Mount Holdings LLC. The appraisal district's online record gives the property's location as FM 902 in Howe and lists a San Antonio mailing address for the owner.

Under the proposed ordinance, the zoning would change from SF-1 (Single-Family 1) to M-2 (Manufacturing 2). The notice lists the proposed uses as a "Wastewater Resource Recovery Facility and other authorized uses." It does not say who would build or operate the facility, how large it would be, or which customers it would serve.

The PDF the city posted is titled "2026 1020 RL Notice of Public Hearing BVRT1." The notice itself does not explain that label. In September the council approved a sewer franchise for a private company, BVRT II, under Ordinance 833B; that ordinance calls for the company to build a treatment plant in the northern part of town.

Nothing in the zoning notice ties this tract to that franchise.

How to weigh in

Residents and property owners can speak at either hearing or send a letter to the City of Howe, Attn. City Council/Planning & Zoning, 116 E. Haning St./PO Box 518, Howe, Texas 75459. Letters must arrive by 5 p.m.

Friday, Oct. 16, to go into the commission and council packets; the notice says responses that come in after that date will not be counted in the record.

A formal protest must object to the rezoning, include a legal description of the protesting owner's property and carry the owner's signature.

If owners of land within 200 feet of the tract who together hold at least 20% of the land area covered by state law file written opposition, the notice says the council could approve the change only with at least three-fourths of its full membership voting yes.
